General Terms and Conditions (GTC)

§1 Applicability to entrepreneurs and definition of terms

​

(1) The following General Terms and Conditions of Business apply to all deliveries between Simone Krautter and a consumer in the version valid at the time of the order.  Simone Krautter's product & services are directed exclusively at users who have reached the age of 18 and are consumers (hereinafter referred to as "participants" or "you").A consumer is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to his commercial nor to his independent professional activity (§ 13 BGB).

§2 Conclusion of contract

(1) The following regulations on the conclusion of the contract apply to orders placed via our website: http://www.simonekrautter.com .

(2) In the event of the conclusion of a contract, the contract shall be concluded with

(3) Registration and confirmation

Registration for a course, workshop, session or retreat will be done via the website or in writing (e-mail, whatsapp, instagram,..).

Website Registration:

3.1. Select one of your desired products, workshops, session, courses from our website.

3.2. By clicking the RSVP button (Reserve my spot/place) and entering your information/ contact details on our website you will make a binding offer (§ 145 BGB). 

3.3. After you put in your details, you will receive an e-mail confirming that I received your request (confirmation of receipt). The confirmation of receipt does not constitute an acceptance of your offer. A contract is not yet concluded by the confirmation of receipt. 

3.4. A registration for distance selling transactions (internet, email) is completed as soon as there has been a written confirmation by Simone Krautter. This is done via a message by e-mail, Messenger or Instagram.

Phone/Email Registration:

You also have the option of booking a session offered by me by telephone or by e-mail to hello@simonekrautter.com. By doing so, you make a binding offer. By doing so, you are making a binding offer (§ 145 BGB).

A contract is only concluded when I expressly declare acceptance of the offer and confirm the registration.

(4) Storage of the contract text for orders via our Internet shop: We store the contract text and send you the order data and our General Terms and Conditions by e-mail. You can also view the GTC at any time at http://www.simonekrautter.com/gtc. You can view your past orders in our customer area under My account --> My orders.

§ 3. Duration of the contract

The duration of the contract is determined by the chosen offer of the contractual partner/customer. In the case of contracts with a time limit, the contract is valid until the end of the offer. Termination is excluded here. Continuing courses can be terminated at any time by either party.

§4. Terms of payment

The session fee listed on the website and in the registration confirmation as well as the fee for the retreats include all mandatory price components.

Simone Krautter offers the following payment methods: Bank transfer or Paypal

Payment deadline: Immediately with Confirmation Email.

Simone Krautter is responsible for choosing the payment method available in each case. In particular, Simone Krautter reserves the right to offer you only selected payment methods for payment, for example, only advance payment to secure credit risk. If the participant defaults on a payment, the participant is obliged to pay the statutory default interest of 5 percentage points above the base interest rate.

§5. Participation

Participation in a course is only possible with prior registration. The fees are due immediately upon registration. A place on the course is not secured until the fee for the course has been received. The fee is to be paid into one of the mentioned accounts.

§6. Booking Policy , Cancellations, Transfers & Refund

​

This policy is presented at the time of purchase. Full or partial payment equals consent to the following terms. 

All purchases include a non-refundable 10% of the event price administration fee.

RULES FOR TICKET CANCELLATION, TRANSFER AND REFUND for in person Workshops/Sessions/Retreats/Festivals

If Simone Krautter cancels your booking or if you as a participant cannot join as planned, the following applies:

 

    • §1: CANCELLATION UP UNTIL 30 DAYS BEFORE THE EVENT STARTING DATE
      Up until 30 days before the event’s starting date you can cancel your ticket and get a refund, minus the 10% (of the event) administration fee per person. 

    • §2: CANCELLATION UP UNTIL 14 DAYS BEFORE THE EVENT’S STARTING DATE
      Up until 14 days before the event’s starting date you can cancel your ticket and get a refund, minus a cancellation fee. The cancellation fee is 50% of the total booking value.

    • §3: CANCELLATION LESS THAN 14 DAYS BEFORE THE EVENT STARTING DATE
      We do not offer a refund in the last two weeks before the event starts unless you have a doctor’s confirmation that you are hindered to participate. If you have a valid doctor’s confirmation you receive a refund of 50% of the total booking value.

    • §3: CANCELLATION AT THE EVENT STARTING DATE /DURING EVENT

    •  Once the event has started, no refunds are made. This applies also after check-in if you should fall ill or for any reason cannot stay for the full event. In case of non-appearance without prior cancellation for a booked retreat, the full participation fee is due or the participation fee will not be refunded.

    • §4: TRANSFER YOUR BOOKING TO ANOTHER EVENT OR PERSON
      If you are hindered from attending the event you have booked, you can transfer your reservation to another event currently bookable via our website. We charge a 10% (of the event price) administration fee per booking to perform the transfer to another event. 

    • §5: SIMONE KRAUTTER CANCELS YOUR BOOKING
      In the unlikely event that Simone Krautter cancels your booking, you will receive a full refund minus a 10% (of the event price) administration fee per booking. We intend to communicate any decision to cancel the event at least 14 days in advance, with a reservation that unforeseen circumstances may prevent us from doing so.

    • §6: HEALTH, TRAVELS & ADDITIONAL POLICIES/GUIDELINES

    • Simone Krautter expects you to cancel your participation if you, close to the start of the event (or during the event itself) know, or have a valid reason to believe, that you are carrying a contagious virus. We refer to you having strong symptoms of for example stomach flu, influenza or COVID-19 here, diseases that may cause an immediate health risk for other participants. 

    • For participation (accommodation), legal regulations may require the presentation of a negative COVID19 test at the venue (e.g. yoga or coaching room, seminar house or other retreat venue). The obligation to test does not give rise to any right of withdrawal or cancellation on the part of the participant. If travel from a risk area is prohibited for legal reasons, participation will be postponed to the next possible date for Simone Krautter and the participants. The deposit will be due or non-refundable.

    • There is no reimbursement for any travel costs or restriction if you can not enter the country. Please consider booking refundable travel tickets to join the events. 

    • Simone Krautter is solely responsible for the organisation and implementation of the sessions & retreats and is not a tour operator or travel agent.

    • The scope of services to be provided by Simone Krautter extends exclusively to the implementation of the sessions or retreats and, if specified in the respective description, the catering of the participants. Simone Krautter does not provide or arrange any services in connection with the participant's arrival and departure or accommodation.

NO RIGHT OF WITHDRAWAL

  • The booking of one of my services is a service in connection with a leisure activity. According to § 312g para. 2 no. 9 BGB, there is no right of withdrawal for consumers for such services.

§7 Visual material

Simone Krautter reserves the right to take photos and videos at events such as workshops. These may be used for promotional purposes for events, in social media, on the website or for flyers. Simone Krautter thus retains the rights to images and videos by attending a retreat/session/workshop purchased via http://www.simonekrautter.com. The participant undertakes to inform Simone Krautter immediately if he/she does not wish to be represented publicly in photos & videos and wishes to restrict the accompanying right of use.

§8 Limitation of liability

Simone Krautter is in principle not liable for damages of the participants. This does not apply to liability due to a breach of an essential contractual obligation and to liability due to damage to the participants from injury to life, body or health which is based on an intentional or negligent breach of duty by Simone Krautter, its legal representatives or vicarious agents; the limitation of liability also does not apply to other damage to the participant which is based on an intentional or grossly negligent breach of duty by Simone Krautter, its legal representatives or vicarious agents. Essential contractual obligations are those whose fulfilment makes the proper execution of the contract possible in the first place and on whose compliance the contractual partner may regularly rely.

No liability is assumed for accidents caused by the customer.

Simone Krautter does not assume any guarding or duty of care for valuables brought into the sessions or retreats.

The participant is liable for any objects or facilities damaged by him/her.

§9. Clarification & Advice, "Mental Healing" / Geistesheilung  (BVerfG, 02.03.2004).

Consulting, energy work and participation in the workshops, trainings and seminars is at the client's own responsibility and does not replace medical, medical or psychotherapeutic treatment. The purpose of this work is help for self-help, relaxation, well-being, spiritual healing and personality development. According to the law, mental healing activates the self-healing powers (BVerfG, 02.03.2004). It does not replace diagnosis and treatment by a doctor, alternative practitioner, therapist or similar, nor does the counsellor make diagnoses or prescribe medication. There are no medical examinations, diagnoses, consultations or treatments. The client agrees not to use the consultation or application as an opportunity to interrupt, discontinue or not even begin necessary treatment with a doctor or other therapist. The same applies to the use of necessary medication. The client shall inform the consultant of existing illnesses, allergies or intolerances so that these can be taken into account accordingly in the applications and recommendations. A preventive or relaxing application can also lead to initial reactions, such as low blood pressure, headaches or dizziness. The application of spiritual healing methods is an intensive experience that can be expressed through physical sensations. The client takes responsibility for his development process and for the conclusions he draws from the consultation. 

The treatment can also be done by remote healing sessions. According to the legal definition, remote healing is the treatment or recognition of diseases, ailments, physical damage or pathological complaints that are not based on the client's own perception of the person or animal to be treated. The healer does not practise medicine, so that a legal permission is not necessary. During remote treatments, the client can stay at home completely relaxed, the energy transfer is as intensive as if he were on site.​
